General Terms And Conditions Of Sale

Introduction and Scope of Application
Welcome to www.najibaofficial.com. This document sets out the NAJIBA General Terms and Conditions of Sale (“Terms”) applicable to all product sales made through  www.najibaofficial.com, as well as the provisions relating to delivery and return processes.

Definitions:

  • “Product”: All jewellery, accessories, and other items offered for sale on www.najibaofficial.com.

  • “Customer”: Any natural or legal person placing an order through the website.

  • “Contract”: The sales agreement formed when the Customer’s order is accepted by NAJIBA.

  • “Website”: The domain name www.najibaofficial.com and all its subpages belonging to NAJIBA.

Please read these Terms carefully before placing your order. This document explains who we are, how we will deliver products to you, how the contract can be amended or terminated, what to do if there is an issue with your product, and other important details.

By placing an order on our website, you confirm that you accept these Terms. If you do not agree, please do not place an order.

NAJIBA reserves the right to amend these Terms at any time. The updated version will take effect from the date it is published on the website and will only apply to orders placed thereafter. We recommend reviewing the Terms before each purchase.

Sales via the website are currently valid only for deliveries within Turkey. For international deliveries, please contact us directly. For international orders, customs duties and import charges are the responsibility of the customer and may be subject to local regulations.

3. OUR PRODUCTS

The product images and descriptions displayed on our website are for illustrative purposes only and may not fully represent the exact appearance of the final product. Due to device display settings, lighting conditions, or photography techniques, there may be minor tone or detail differences between the product you receive and the one shown on your screen. Each piece is a unique work of art crafted by our artisans; therefore, please note that slight variations in tone and texture from what you see on screen may occur.

Product dimensions and weights may vary within a ±5% tolerance due to the handmade nature of our creations.

Product packaging may differ from the images shown on our website depending on stock availability or production processes.

Some of our products offer personalisation or custom design options. Where this service is available, the relevant information and options will be clearly stated on the product page.

  • Personalised products may require additional production time.

  • For personalised or made-to-order products, the right of withdrawal and return conditions may differ (see Returns Policy).

 

4. ORDERS

4.1 Order Acceptance

Your order is considered accepted when your payment is confirmed and you either see the order confirmation page or receive an order confirmation email (whichever occurs first). At this point, a legal contract is formed between you and NAJIBA for the sale and delivery of the product(s) ordered.

You are solely responsible for providing accurate and complete contact details when placing your order. We cannot be held liable if we are unable to contact you due to incorrect information.

4.2 Circumstances for Order Refusal

NAJIBA reserves the right to refuse or cancel your order in the following cases:

  • Violation or prior breach of these Terms,

  • Suspicion of fraudulent or abusive activity,

  • Product out of stock,

  • Clear error in price or description,

  • Payment details cannot be verified,

  • Payment not received,

  • Technical or legal compliance issues,

  • Any other circumstances beyond our control.

In such cases, we will inform you via email or phone, and any payment taken will be refunded to your original payment method.

4.3 Fraud and Security Checks

Orders may be screened using third-party security software to prevent fraud.
The billing name and address must match the cardholder’s details. If there is a mismatch, the order may be cancelled.

4.4 Maximum Purchase Policy

To preserve the limited-edition nature of our collections and ensure fair access for all customers, purchases are limited to a maximum of 4 units of the same product model within a 12-month period.

NAJIBA reserves the right to review order history and cancel any orders — including current and future orders — that are deemed to be intended for commercial resale. This applies where bulk purchasing, unusually high quantities of the same product, or resale to third parties is identified.

4.5 Order Cancellations

NAJIBA reserves the right to cancel an order in whole or in part in the following circumstances:

  • Product is out of stock,

  • Clear error in product price or description,

  • Incomplete or incorrect payment details,

  • Delivery to the specified address is not possible,

  • Duplicate orders placed,

  • Suspicion of fraud or misuse,

  • Exceptional circumstances beyond our control.

In the event of cancellation, the customer will be notified via email or phone. If payment has been taken, it will be refunded to the original payment method. If the order has already been shipped, our Returns Policy will apply.

5. PRICE AND PAYMENT

5.1 Display of Prices

All prices listed on our website are in Turkish Lira (₺) and include VAT.
Prices are clearly displayed in your cart and on the checkout page.

For international orders, payments are processed in Turkish Lira; your payment provider may determine the exchange rate and apply transaction fees. NAJIBA is not responsible for any exchange rate differences or transaction fees.

5.2 Tax and Fee Changes

If the legal VAT rate changes after your order is placed:

  • If payment has been made, the previous rate applies.

  • If payment has not been made, the new rate applies.

Customs duties and import charges for international deliveries are the responsibility of the customer and are not included in the product price.

5.3 Pricing Errors

If a clear pricing error or system malfunction is detected, we will contact you before processing your order.
If the error is obvious and could reasonably have been noticed, NAJIBA reserves the right to cancel the order, refund your payment, and request the return of the products.

  • Iyzico Secure Payment (3D Secure)

Cash on delivery is not available.

5.5 Security Checks

The billing name and address must match the cardholder’s details.
All card payments are processed through 3D Secure or the issuing bank’s secure payment system with encrypted protection.

6. DELIVERY

6.1 Delivery Areas

6.2 Standard Delivery (Within Turkey)

  • All domestic deliveries within Türkiye are handled via contracted courier companies.

  • Orders are dispatched within 1–3 business days after payment confirmation.

  • For personalised or custom-made items, this period may extend to 3–7 business days depending on production time.

  • No shipments are made on weekends or public holidays.

  • Free standard delivery applies to orders over ₺[limit]. For orders below this amount, a fixed delivery fee of ₺[fee] applies.

  • Delivery times may vary depending on your location and courier workload.

6.3 International Delivery

  • International delivery times and fees vary depending on the destination country and selected courier service.

  • All customs duties, import charges, and local taxes are the responsibility of the customer and are not included in the product price or shipping fee.

  • Customs clearance may cause delivery delays beyond NAJIBA’s control.

6.4 Special Delivery (Concierge Delivery)

  • For selected areas within Istanbul, same-day or next-day hand delivery may be available by appointment.

  • This service is subject to stock availability and delivery team schedules.

  • Please contact our customer service before placing your order to arrange this service.

6.5 Delivery Addresses

  • Deliveries can only be made to physical addresses.

  • We do not deliver to PO Boxes or addresses that do not accept parcel deliveries.

  • NAJIBA is not responsible for failed deliveries due to incomplete or incorrect address details provided by the customer.

6.6 Delivery Confirmation & Tracking

  • Once your order has been shipped, you will receive a tracking number by email.

  • You can follow the delivery status using the courier company’s tracking system.

6.7 Damaged Products Upon Delivery

  • Please check the package upon delivery before signing for it.

  • If damage is detected, request the courier to issue a damage report before accepting the delivery.

  • Damaged product notifications must be made to our customer service team within 24 hours of delivery.

  • Without a damage report, return or exchange requests for shipping-related damages may not be accepted.

7. RETURNS & EXCHANGES POLICY

7.1 General Conditions

  • You may return products purchased from NAJIBA within 14 days of receipt, in accordance with the Distance Sales Agreement.

  • Returned products must be unused, undamaged, and sent back in their original packaging, including all accessories, certificates, warranty documents, and gift packaging.

  • The product must be returned exactly as delivered.

7.2 Non-Returnable Items

The following items cannot be returned or exchanged:

  • Personalised or custom-made products (e.g., jewellery engraved with initials/names or made to specific measurements),

  • Items that come into direct contact with the body and have been opened/used (e.g., earrings) — except in cases of manufacturing defect,

  • Products that have been altered, damaged, or are no longer in their original condition.

7.3 Return Shipping Costs

  • If the product is faulty or damaged, NAJIBA covers the return shipping cost.

  • For returns made under the right of withdrawal (change of mind), the return shipping cost is borne by the customer.

7.4 Value Deduction

  • If there is a loss in value due to handling or use of the product during the return period, the refund amount may be reduced accordingly.

  • The customer will be informed of any deduction and may request the product to be sent back.

7.5 Return Process

2.You will receive return shipping details via confirmation email.

3.Once the product has been received and inspected, your payment will be refunded within14 business daysvia your original payment method.

4.Bank and payment provider processing times may vary.

7.6 Exchange Process

  • Exchanges can be made for products currently in stock.

  • If the requested product is not available, the return procedure will apply or a special order option will be offered.

Luxury Brand Note
Every NAJIBA piece is meticulously handcrafted in limited quantities by our artisans.
For this reason, slight variations in stone tones, metal textures, or hand-finished details may occur.
These are not defects but rather the signature of its uniqueness and artisanal character.

7.7 International Orders

For international orders, returns are not accepted due to local customs and logistics processes. However, in the case of a manufacturing defect, the item will be replaced free of charge.

8. WARRANTY & REPAIR POLICY

8.1 Legal Warranty & NAJIBA Special Care Warranty

  • Legal Warranty (Türkiye only): In accordance with the Turkish Consumer Protection Law, NAJIBA products are covered for 2 years from the date of delivery against manufacturing and craftsmanship defects only.

  • NAJIBA Special Care Warranty: In addition, for 6 months from the date of delivery, NAJIBA offers free maintenance and polishing service for your product.

Not covered under warranty:

  • Damage caused by dropping, impact, bending, denting, or scratching,

  • Exposure to perfume, creams, deodorants, cosmetics, chemicals, or sea/pool water,

  • Normal wear and tear such as tarnishing, fading, or plating abrasion,

  • Improper storage (humid environment, stored without a box or pouch),

  • Any alterations or repair attempts made by the customer.

8.2 Paid Repair Service

  • For damages outside the warranty scope, a paid repair service is available.

  • To request a repair, please contact [najiba@najibaofficial.com] with product photos.

  • Repair times may vary depending on the type of damage and spare part availability.

8.3 Care & Maintenance Advice

  • Keep your jewellery away from perfume, creams, deodorants, cosmetics, and chemicals.

  • Remove your jewellery before showering, swimming, or bathing.

  • Store in its original box or a soft pouch when not in use.

  • For delicate stones and handcrafted details, professional maintenance is recommended at regular intervals.

That is why our care and repair services are offered not only with technical expertise but also with the intention of preserving the artistic soul of each creation.

9. MEMBERSHIP & DATA PROTECTION

9.1 Membership Conditions

  • Creating an account on www.najibaofficial.com is optional; however, members enjoy benefits such as order history tracking, exclusive offers, and faster checkout.

  • You are responsible for ensuring that all information you provide is accurate and complete. NAJIBA cannot be held liable for any issues arising from inaccurate or incomplete information.

9.2 Personal Data Collection & Processing (KVKK & GDPR)

  • NAJIBA processes personal data you provide — including your name, contact details, address, and payment information — when you interact with our website, social media channels, or retail points.

  • Data is collected solely for the purposes of:

    • Receiving and fulfilling orders

    • Delivering products

    • Providing customer service and support

    • Complying with legal obligations

  • Personal data will not be used for marketing purposes without your explicit consent.

  • Data may be disclosed only when required by law or at the request of authorised authorities.

9.3 Data Retention

  • Your personal data is stored in compliance with legal obligations and record-keeping requirements.

11. LIMITATIONS OF LIABILITY

11.1 General Provisions

  • NAJIBA strives to present product information, images, and descriptions on our website as accurately as possible. However, due to variations in screen settings, lighting conditions, and the nature of handcrafted production, slight differences in colour, tone, and details may occur.

  • Such variations do not constitute a defect in the product.

11.2 Liability Regarding Jewellery Use

  • Our pieces are delicate, handcrafted creations. Impact, dropping, exposure to abrasive chemicals, or improper storage may cause irreversible damage.

  • NAJIBA cannot be held responsible for damages caused by misuse or failure to follow care instructions.

  • Jewellery should be kept out of the reach of children and used in accordance with the care guidelines provided.

11.3 Legal Framework

  • These limitations of liability are interpreted within the framework of Turkish Consumer Law and other relevant regulations.

  • These provisions do not affect your statutory rights as a consumer; they simply define NAJIBA’s responsibility within reasonable and foreseeable limits.

12. INTELLECTUAL PROPERTY RIGHTS
12.1 Design & Content Rights

  • All jewellery designs, logos, brand name, images, texts, product names, and collection concepts presented under the NAJIBA brand are protected as works of art and design.

  • All such content is the exclusive property of NAJIBA or its licensors, protected under the Law on Intellectual and Artistic Works and international copyright agreements.

12.2 Prohibited Uses

  • Without prior written permission from NAJIBA, no design, image, text, or other content from our website or social media channels may be copied, reproduced, modified, sold, or used for commercial purposes.

  • Any direct imitation of our products or unauthorised use of design elements will result in legal action.

12.3 Brand & Patent Protection

  • The NAJIBA brand, logo, and distinctive design elements are registered trademarks.

  • NAJIBA’s exclusive Perfume-Dispensing Jewellery designs are protected by relevant patent and design registration certificates.

  • In case of infringement, NAJIBA reserves the right to pursue legal remedies both nationally and internationally.

13. FORCE MAJEURE
13.1 Definition

  • NAJIBA shall not be held liable for any failure or delay in performing its contractual obligations due to events beyond its reasonable control, including but not limited to natural disasters, fire, flood, earthquake, explosion, war, riots, acts of terrorism, government actions, strikes, logistical disruptions, pandemics, or other unforeseeable circumstances.

13.2 Impact on Delivery & Services

  • In the event of force majeure, order delivery times may be delayed or the provision of services temporarily suspended.

  • Customers will be informed promptly, and every effort will be made to resolve the situation as quickly as possible.

13.3 Suspension of the Contract

  • Contractual obligations shall be suspended for the duration of the force majeure event, after which a new delivery or service date will be mutually agreed upon by the parties.

14. GOVERNING LAW

  • These Terms of Sale shall be governed by and interpreted in accordance with the laws of the Republic of Turkey.

  • For international orders, the laws of the Republic of Turkey shall apply, unless otherwise required by mandatory local consumer protection laws.

  • 11.2 Jurisdiction

  • Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the Courts and Enforcement Offices of Istanbul (Central).

  • For customers acting as consumers, local Consumer Arbitration Committees and Consumer Courts may also have jurisdiction according to applicable laws.
